Our Terms and Conditions (“Terms”) describe what we do and what we require from you as a Project Owner or Donor. These Terms also apply to you if you use our Website. Please read them carefully as you are bound by them. If you don’t agree with them, please don’t use our Website.
In these Terms:
“Donor” means individuals, businesses or organisations that make a donation to a Project.
“Let’s Rewild” or “us”, “our” or “we” refers to the owner of the Website, Let’s Rewild Limited, a company registered in England and Wales with company number 12693262 and its registered address at 1, Basset Ford Road, Oundle, Cambridgeshire, PE8 4DW.
“Project” refers to a rewilding crowdfunding project that Donors may choose to support by making a donation via the Website.
“Project Owner” refers to the individual, organisation or company that is the owner or organiser of the Project.
“Website” refers to https://letsrewild.org.
“You”, “you” and “your” refers to each user or viewer of the Website, including Donors and Project Owners.
We may update these Terms from time to time. Please check them wherever you access the Website because the latest version of these Terms will govern your use of the Website. (The date on which these Terms were last updated is stated at the top so you can easily check.)
About the Projects on the Website:
The Website allows you to donate directly to any Project listed on the Website. Whilst we do undertake reasonable due diligence to verify a Project Owner and a Project’s legitimacy, we are not responsible for any Project.
Once your donation is made, it is non-refundable.
Use of your donation
Any donations are made directly to the Project Owner. Let’s Rewild has no liability to Donors whatsoever for any use or misuse of donations made to a Project. The Project page may state that the Project Owner will use donations only for specific purposes, but Let’s Rewild cannot guarantee that they will use them only for such purpose.
If you have any questions about how any Donation will be spent, you should contact the Project Owner directly to seek reassurance. It is your sole responsibility, as a user of the Website, to ensure that the Project is one that you wish to support.
Let’s Rewild fees
Any fee we charge helps us improve the platform and service we provide to you or covers financial transactions. If you would like to contribute to the running costs of Let’s Rewild, please make a donation here. Thank you. Without your support, we would not be able to operate. When you make a donation, the transaction is final and not disputable unless unauthorised use of your payment card or other payment method is proved.
Protecting your account
When you register an account with Let’s Rewild and choose a password, you are responsible for maintaining the confidentiality of your password. If you become aware of any unauthorised use of your account, we recommend that you change your password immediately and Contact Us.
Please use the Website in a responsible and legal manner. If you provide information to us to, for example, apply for an account or for us to feature or publicise your Project, please ensure that the content you provide is accurate, not misleading and does not breach any intellectual property rights of a third party or breach any right or duty owed to a third party.
If your content is copyright-protected, you must obtain the copyright owner’s written consent for us to use it.
Let’s Rewild reserves the right to remove any pictures, photographs, videos or copy from Project pages at its sole discretion and without notice if their accuracy or copyright status is in any doubt. If you suspect a breach of copyright on the Website, please contact us.
By submitting and posting content to the Website, you grant us a perpetual, irrevocable, worldwide, royalty-free and non-exclusive license to use, modify, reproduce, publish, broadcast, display and distribute the Content in any format, using any medium, for the purpose of promoting Let’s Rewild or a Project, or for any other purpose that we deem appropriate (acting reasonably).
When using our Website, please respect us and our users by making sure you do not:
- misrepresent your identity or affiliation with any other person or organization;
- use the Website to send junk email or “spam” to people who do not wish to receive email from you;
- interfere with, or disrupt, the service or services or networks connected to the service or introduce any computer virus (including any variant or similar malicious code or instructions) to Let’s Rewild’s systems;
- attempt to modify, adapt, translate, sell, reverse engineer, decompile or disassemble any portion of the Website or any other website;
- attempt to bypass the network firewall;
- use any party of the Website which you are not authorized to use or devise ways to circumvent security in order to access part of the Website which you are not authorized to access (includes scanning networks with intent to breach and/or evaluate security, whether or not the intrusion results in access);
- use or attempt to use the Website for any unlawful, criminal, or negligent purposes;
- disclose any information relating to any Donor except with the consent of the Donor or as permitted by applicable local laws.
The Website contains links to other websites, including the websites of Projects. Inclusion of a link to another website does not imply endorsement of its content or opinions. Your relationship and any direct transactions with other people or organisations (including your Donations) are your own responsibility.
All content on the Website and its associated services is owned by Let’s Rewild or Project Owners and is protected by intellectual property and proprietary rights and laws. You may use any Website links to share content on social media. If you’d like to use our Website content in any other way, please contact us – we’d love to hear from you!
Changes to the service
We reserve the right to modify, suspend or discontinue all or any part of the Website at any time with or without notice.
Failure to comply with these Terms
In the event that you fail to comply with these Terms, we reserve the right at our sole discretion to immediately and without notice suspend or permanently deny your access to all or part of the Website and to take down any Project pages.
You may discontinue use of the Website and associated services at any time. These Terms will continue to apply to your past use.
Disclaimer and Limitation of Liability
As we are a not-for-profit organisation, we can only offer our Website and services if we take steps to reasonably limit our liability to you.
You agree that your use of the Website is on an “as is” and “as available” basis and that your use of the Website and its associated services is at your sole risk. We do not warrant or guarantee continuous uninterrupted or secure access to the Website and associated services may be interfered with by numerous factors outside of our control. On that basis, except as expressly set out in these Terms and except for the rights, guarantees and remedies which cannot be excluded, Let’s Rewild does not provide any conditions, guarantees, warranties or terms in relation to the Website, to the extent permissible by law.
If found liable, Let’s Rewild shall only be liable under these Terms for direct losses which are reasonably foreseeable and caused by our uncured material breach of these Terms or our negligence.
Let’s Rewild’s total liability to you arising under or in connection with these Terms, whether in contract, tort (including negligence), breach of statutory duty or otherwise, shall in no circumstances exceed the total sum of the donations you have made or received using the Website in the preceding 12-month period, ending on the date the circumstances giving rise to Let’s Rewild’s liability arose.
In no event shall Let’s Rewild be liable for:
- losses relating to the use or misuse of donations by a Project;
- any business losses;
- lost or corrupt data;
- loss of profits;
- loss of contracts;
- loss of business opportunity;
- loss of sales;
- loss of revenue;
- loss of goodwill;
- loss of any software or hardware;
- loss of or waste of management or other staff time,
even if Let’s Rewild has been advised of the possibility of such damages.
You expressly agree to this allocation of risk.
Nothing in these Terms excludes any legal rights (called statutory terms) which may apply to your use of the Website which cannot be excluded, restricted or modified by contract.
A person who is not a party to these Terms has no right to enforce any term of these Terms.
These Terms and any contractual or non-contractual dispute arising out of or in connection with your use of the Website or the associated services are governed by English law.
